Transplantation continues to push the frontiers of medicine into domains that summon forth troublesome ethical questions. Looming on the frontier today is human facial transplantation. We develop criteria that, we maintain, must be satisfied in order to ethically undertake this as-yet-untried transplant procedure. We draw on the criteria advanced by Dr. Francis Moore in the late 1980s for introducing innovative procedures in transplant surgery. In addition to these we also insist that human face transplantation must meet all the ethical requirements (...) usually applied to health care research. We summarize the achievements of transplant surgery to date, focusing in particular on the safety and efficacy of immunosuppressive medications. We also emphasize the importance of risk/benefit assessments that take into account the physical, aesthetic, psychological, and social dimensions of facial disfiguration, reconstruction, and transplantation. Finally, we maintain that the time has come to move facial transplantation research into the clinical phase. (shrink)

The Protein Ontology (PRO) provides a formal, logically-based classification of specific protein classes including structured representations of protein isoforms, variants and modified forms. Initially focused on proteins found in human, mouse and Escherichia coli, PRO now includes representations of protein complexes. The PRO Consortium works in concert with the developers of other biomedical ontologies and protein knowledge bases to provide the ability to formally organize and integrate representations of precise protein forms so as to enhance accessibility to results of protein (...) research. I offer a new theory of faultless disagreement, according to which truth is absolute (non-relative) but can still be non-objective. What's relative is truth-aptness: a sentence like ‘Vegemite is tasty’ (V) can be truth-accessible and bivalent in one context but not in another. Within a context in which V fails to be bivalent, we can affirm that there is no issue of truth or falsity about V, still disputants, affirming and denying V, were not at fault, since, in their context (...) of assertion V was bivalent. This theory requires a theory of assertion that is a form of cognitive expressivism. (shrink)

Članek ponovno odpira razpravo o recepciji dela Louisa Althusserja v teoriji in kritiki kulture v luči nedavnih angleških prevodov posthumnih del tega francoskega filozofa, vključno z nedokončanim Sur la reproduction, ki vsebuje tudi spis »Ideologija in ideološki aparati države«. Izmed marksističnih mislecev njegove generacije ni bil nihče v tolikšni meri tarča očitkov teoreticizma in političnega odpadništva kot prav Althusser, kar Rancière opisuje kot »althusserjansko zanikanje političnih učinkov«. Članek predstavi pregled zgodovinskih teženj in nasprotnih teženj, ki jih najdemo v Althusserjevih spisih (...) med »dolgimi šestdesetimi«, in trdi, da ne smemo podcenjevati vloge teorije in teoretikov v prid osvobajajočih praks maja 1968, ampak moramo Althusserjev domnevni teoreticizem misliti v kontekstu politično motiviranih teoretskih bojev in rivalstev, ki so določali »politiko njegovega časa«. V zaključku opažamo, da bi preusmeritev pozornosti k tem bojem lahko pripeljala do drugačnega pojmovanja vloge teorije po letu ‘68. (shrink)

Kljub temu, da je bil Louis Rossel eden vodilnih akterjev v francoski državljanski vojni, se ga veliko manj spominjamo in je tudi veliko manj spoštovan kot vodilni misleci komune. Tu analiziram njegovo sodelovanje pri tem dogodku in pri predhodni kampanji Nacionalne obrambe, opirajoč se pri tem tako na biografijo Edith Thomas kot na Rosslova lastna posthumna dela. Prevladujoča domneva, da je Rossla motivirala lastna ambicioznost, ki naj bi bila pogubna za usodo komune in nasprotujoča njenim revolucionarnim egalitarnim načelom, se na (...) podlagi obstoječih dokazov zdi poenostavljena. Še več, takšni domnevi lahko nasprotujemo z interpretacijo komune in državljanske vojne v Franciji kot drame, še posebej če se navežemo na dela Jeana-Pierra Vernanta in Pierra Vidala-Naqueta o grški tragediji. Received doctrine has an 'antecedent' message encoded within a conditional clause, such as the string comprising the first five words of the sentence 'If the bough had broken the cradle would have fallen'. Criticisms of mine of this tenet were recently challenged by Stephen Barker. In the course of responding to his examination, I venture a snappy demonstration that the 'conditionals' such sentences encode can have neither 'antecedents' nor 'consequents'. To vprašanje se opira na predstavo o kognitivnem mapiranju, kot sta ga raziskovala Toscano in Kinkle v Cartographies of the Absolute, v nadaljevanju pa avtor glede na to vprašanje obravnava abstraktne potenciale računalnikov in Turingovega stroja, ki omogočajo izdelavo algoritmičnega modela kapitalizma.

The English Court of Appeal is currently faced with three analytically distinct approaches to the question of when one party owes another a duty of care in respect of her economic interests, all of which bear the authority of the House of Lords. Unable to choose between them, it has recently adopted a fourth approach combining which combines them, in the apparent belief that the combination will eradicate any individual deficiencies. Against the background of a recent case, the author argues (...) that this is a holding strategy at best and methodologically deficient. He also challenges the continuing lip-service paid by courts to models of liability based upon ‘assumptions of responsibility,’ examining and criticising the causes of their persistence in the law in the face of widespread academic criticism. Instead, the author argues, the House of Lords should now clearly endorse a single reasoning strategy to economic loss cases based on the three-stage approach in Caparo Industries v Dickman. Properly understood, this approach offers the best prospect of facilitating consistent and transparent decision-making in the longer term. (shrink)

The international scientific-practical conference under this name took place on May 19-21, 1995 in Ostroz, Rivne oblast, on the basis of the Ostroh High College. The conference summed up the domestic and foreign experience of educating the younger generation on the basis of Christian morals, developed theoretical and practical recommendations for the establishment of Christian morals in everyday life of man. Professors Vyacheslav Briukhovetsky, Helen Barker, Vilen Gorsky, Victor Malakhov, Peter Yarotsky, Nikolay Kovalsky, Ihor Pasichnyk, teachers, employees of educational (...) institutions and scientific institutions of 18 cities of Ukraine took part in the conference. The conference was attended by representatives of five Christian denominations. As a result of the work of the conference, a collection of abstracts of reports delivered therein was published. In his first major publication, the Mysterium Cosmographicum, Johann Kepler undertook to answer several questions--most notably why there are six planets and why their orbits have a particular relative spacing. Neither Kepler's answers to these questions nor the questions themselves survived the transition to Newtonian physics. Kepler's conviction about the importance of his questions, and his early answers to them, provided the foundation for his subsequent scientific work, including the discovery of the laws of planetary motion for which he is (...) now chiefly remembered. Near the end of his career, in 1621, Kepler produced a second edition of the Mysterium, differing from the first only in the addition of copious notes; in it he refers to his Harmonice Mundi as a vindication of the insights of the Mysterium. This book considers the efficacy of the common regulatory model of the licensing regime as a means of regulating animal use in England, with a particular focus on wild animals and the regime’s ability to ensure animal welfare needs are met. Using information gleaned from over 550 inspection reports relating to the period 2008 through 2019, obtained using FOI Act requests, the book analyses the extent to which animals used by these industries are protected by law. Tyson analyses the (...) limitations present in the practical application of English legislation responsible for creating a number of relevant licensing regimes.The regimes discussed include: The Zoo Licensing Act 1981, the now repealed Welfare of Wild Animals in Travelling Circuses Regulations 2012, and the Animal Welfare Regulations 2018, introduced under the Animal Welfare Act 2006. Exploring the weakness in the use of this type of regulatory model, Tyson proposes compelling recommendations for change in future policy development. Making an important contribution to the question of enforcement of animal welfare laws, this book provides useful and original insights into the implementation of licensing regimes, and will be of particular interest to scholars of animal welfare law, animal ethics, and critical animal studies. The pressure for results applied by some research funders concerns some academicians. Sometimes, for example, a sponsor requests preliminary data that the researcher is not ready to release. This paper presents three interviews — two with researchers and one with a representative from industry — dealing with these issues and makes recommendations on the basis of those interviews. It also looks briefly at the different norms that exist in industry and academia for research and communication and the tensions these can (...) cause for a scientist working simultaneously in both realms. I argue that one’s views about which “metaphysical laws” obtain—including laws about what is identical with what, about what is reducible to what, and about what grounds what—can be used to deflect or neutralize the threat posed by a debunking explanation. I use a well-known debunking argument in the metaphysics of material objects as a case study. Then, after defending the proposed strategy from the charge of question-begging, I close by showing how the proposed strategy can be used by certain (...) moral realists to resist the evolutionary debunking arguments. A fundamental fact is “pure” just in case it has no grounded entities—ex. Tokyo, President Biden, the River Nile, {Socrates}, etc.—among its constituents. Purity is the thesis that every fundamental fact is pure. I argue that Purity is false. My argument begins with a familiar conditional: if Purity is true, then there are no fundamental “grounding facts” or facts about what grounds what. This conditional is accepted by virtually all of Purity’s defenders. However, I argue that it is also the (...) first step toward Purity’s undoing. For, if every grounding fact has a ground, then some grounded entities have “groundmates” or distinct grounded entities that share their full grounds. But, if there are groundmates, then Purity is false. So Purity leads to a contradiction. Therefore, it is false. I close by noting that my argument against Purity also gives us a powerful reason to think that some grounding facts are fundamental. (shrink)

The view that it is better for life to be created free of disability is pervasive in both common sense and philosophy. We cast doubt on this view by focusing on an influential line of thinking that manifests it. That thinking begins with a widely-discussed principle, Procreative Beneficence, and draws conclusions about parental choice and disability. After reconstructing two versions of this argument, we critique the first by exploring the relationship between different understandings of well-being and disability, and the second (...) by more briefly focusing on the idea of a significant reason. By placing these results against the broader historical and ongoing contexts in which the lives of those with disabilities have been deemed of inferior quality, we conclude with a call for greater humility about disability and well-being in thought and practice. The impressive variation amongst biological individuals generates many complexities in addressing the simple-sounding question what is a biological individual? A distinction between evolutionary and physiological individuals is useful in thinking about biological individuals, as is attention to the kinds of groups, such as superorganisms and species, that have sometimes been thought of as biological individuals. More fully understanding the conceptual space that biological individuals occupy also involves considering a range of other concepts, such as life, reproduction, and agency. There has (...) been a focus in some recent discussions by both philosophers and biologists on how evolutionary individuals are created and regulated, as well as continuing work on the evolution of individuality. Chapter 1 carries the title given to early English translations of the Lettres provinciales; chapter 2 recalls the description of Pascall by Boyle and other English scientists; and chapter 3 draws from Kennett's preface to his version of the Pensees. The heading of chapter 4 is from Pope's Essay on Man. The exclamation which introduces chapter 5 concludes (...) an essay in the Gentleman's Magazine for 1789, probably by Boswell; the words for chapter 6 come from a pastoral letter of John Wesley; and chapter 7 represents the verdict of Coleridge. The title of the book itself is derived from the heading to the twenty-first chapter of Kennett's Pensees, which seems to have forecast the essence of the eighteenth-century's perplexity upon the issues raised by Pascal: 'The strange Contrarieties discoverable in Human Nature, with regard to Truth, and Happiness, and many other things.'. According to the Ontological Innocence Thesis (OIT), grounded entities are ontologically innocent relative to their full grounds. I argue that OIT entails a contradiction, and therefore must be discarded. My argument turns on the notion of “groundmates,” two or more numerically distinct entities that share at least one of their full grounds. I argue that, if OIT is true, then it is both the case that there are groundmates and that there are no groundmates. Therefore, so I conclude, OIT is (...) false. Moreover, once we have seen why OIT is false, only three heterodox views about reality's structure remain. So this paper’s second conclusion is that, even after we have discarded OIT, we are in for an additional surprise. (shrink)

Cinema Derrida charts Jacques Derrida's collaborations and appearances in film, video, and television beginning with 1983's Ghost Dance (dir. Ken McMullen, West Germany/UK) and ending with 2002's biographical documentary Derrida (dir. Dick and Ziering, USA). In the last half of his working life, Derrida embraced popular art forms and media in more ways than one: not only did he start making more media appearances after years of refusing to have his photo taken in the 1960s and 1970s, but his philosophy (...) started to draw more explicitly from visual culture and artistic endeavours. While this book offers explanations of this transition, it contends the image of "Jacques Derrida" that emerges from film and TV appearances remains spectral, constantly deferring a complete grasp of him. Tyson Stewart draws out the main tenets of spectrality from Derrida's seminal texts Of Grammatology and Specters of Marx and other writings, like Echographies of Television, in order to fill a gap in studies of Derrida and film. Throughout the book, he explains how various techniques and spectral effects such as slow motion, stillness, repetition, mise-en-abîme, direct address, and focus on body parts/bodily presence bring about a structure of spectrality wherein the past other returns to make impressions and ethical demands on the viewer. Drawing on communication theory and film and media studies, Cinema Derrida makes a major intervention in classical communication thought. (shrink)

In an educational landscape dominated by discourses and practices of learning, standardized testing, and the pressure to succeed, what space and time remain for studying? In this book, Tyson E. Lewis argues that studying is a distinctive educational experience with its own temporal, spatial, methodological, aesthetic, and phenomenological dimensions. Unlike learning, which presents the actualization of a student’s "potential" in recognizable and measurable forms, study emphasizes the experience of potentiality, freed from predetermined outcomes. Studying suspends and interrupts the conventional (...) logic of learning, opening up a new space and time for educational freedom to emerge. Drawing upon the work of Italian philosopher and critical theorist Giorgio Agamben, Lewis provides a conceptually and poetically rich account of the interconnections between potentiality, freedom, and study. Through a mixture of educational critique, phenomenological description, and ontological analysis, Lewis redeems study as an invaluable and urgent educational experience that provides alternatives to the economization of education and the cooptation of potentiality in the name of efficiency. The resulting discussion uncovers multiple forms of study in a variety of unexpected places: from the political poetry of Adrienne Rich, to tinkering classrooms, to abandoned manifestos, and, finally, to Occupy Wall Street. By reconnecting education with potentiality this book provides an educational philosophy that undermines the logic of learning and assessment, and turns our attention to the interminable paradoxes of studying. The book will be key reading for scholars in the fields of educational philosophy, critical pedagogy, foundations of education, composition and rhetoric, and critical thinking and literacy studies. The concept of empathy in history education involves students in the attempt to think within the context of historical agents’ particular predicaments. Tracing the concept’s philosophical heritage to R. G. Collingwood’s philosophy of history and ‘re-enactment doctrine’, this article argues that our efforts in history classrooms to understand historical agents by their own standards are constrained by a tension that arises out of the need to disconnect ourselves from a present that provides the very means for understanding the past. Though (...) rather than serving to undermine the concept, it is proposed that the moderate hermeneutics of H.-G. Gadamer, through a positive conception of prejudice, tradition and temporal distance, transforms the factors typically seen as inhibitors to empathy’s operation into those that potentially enable it. The article aspires to shed new light on what is at play when history students engage in the intellectually demanding task of empathizing in history. (shrink)

In this paper I want to examine a view of the Darwinian theory of evolution which was put forward fairly recently by A. R. Manser. His approach is of interest not only in itself, but also because it may be expanded to raise some fundamental questions about the nature of the science of biology in general. I shall not consider these further implications here, but shall concentrate on an examination of his thesis in the context in which it is raised. (...) My paper falls into two sections. In the first I shall state Manser's thesis and some of the arguments with which he supports it, and shall try to show how a series of objections raised by A. G. N. Flew and K. Connolly may be answered. In the second I shall offer on my own account a positive argument to provide a possible basis for his point of view, with the aim of indicating why the theory should be of the kind he suggests, and what form the study of evolution must take. We argue that in contemporary business organizations, in which fundamental purpose is construed to be increased value—especially in ‘participative’ organizations, in which non–hierarchal interaction (for example, work teams) is the norm; and in ‘adaptive’ organizations, in which unpredictable change is the rule—a process of values covenanting will be much more valueable than just espoused values or even values covenants. We propose such a process model for organizational values covenanting and argue that such covenanting reflects an anthropomorphism of the human character (...) development process, validated in terms of the theory of viable systems. Within recent feminist philosophy, controversy has developed over the desirability, and indeed, the possibility of defining the central terms of its analysis-"woman," "femininity," etc. The controversy results largely from the undertheorization of the notion of definition; feminists have uncritically adopted an Aristotelian treatment of definition as entailing metaphysical, rather than merely linguistic, commitments. A "discursive" approach to definition, by contrast, allows us to define our terms, while avoiding the dangers of essentialism and universalism.
